Summary

MotionRecord is an offline app. All sensor and tour data stays on your device – we send no app data to servers. For the website we use Umami for anonymous audience measurement – a cookie-free, self-hosted analytics tool that sets no cookies, stores no personal data and shares nothing with third parties. No advertising or tracking cookies are used.

2. Principle: Privacy by Design

MotionRecord was developed according to the “Privacy by Design" principle:

  • All sensor data (lean angle, IMU, GPS) stays exclusively on your device
  • No registration or account required
  • No analytics or tracking tools in the app
  • No advertising, no sharing with third parties
  • The website's audience measurement is cookie-free and anonymous (Umami, self-hosted)

3. Cookies on this website

This website sets no cookies – neither technically necessary ones nor analytics, advertising or tracking cookies. Audience measurement (Umami, see section 4) also works entirely without cookies.

Since no consent-requiring cookies or tracking technologies are used (Section 25 (2) TDDDG / Art. 5 (3) ePrivacy Directive), this website needs no cookie banner.

4. Audience measurement with Umami

4.1 Description and scope

This website uses Umami, a cookie-free, privacy-friendly open-source web analytics tool that we host ourselves on a server in Germany (stats.kurvenfokus.de). Umami helps us understand which content is used so we can improve our offering.

Umami sets no cookies and transfers no data to third parties or third countries (e.g. the USA). There is no profiling, no cross-device recognition and no fingerprinting. Identification of individual persons is not possible.

4.2 Data processed

Umami collects only aggregated, anonymous usage data:

  • Pages visited and time spent
  • Referrer URL (where you came to the page from)
  • Device/browser type, operating system, screen size, language
  • Approximate country of origin (derived from the IP address – the IP address itself is not stored)
  • Anonymous click events (e.g. a click on the “Try beta" button), with no personal reference

4.3 Legal basis

Because Umami works cookie-free and does not access information on your device, no consent under Section 25 TDDDG is required. The legal basis for the anonymous, data-minimising audience measurement is our legitimate interest pursuant to Art. 6 (1) (f) GDPR in the needs-based design and improvement of our offering.

4.4 Objection

You can object to the anonymous audience measurement at any time by using a tracking or script blocker in your browser. Since Umami sets no cookies and stores no personal data, no further opt-out is technically necessary.

5. Google Search Console

We use Google Search Console, a free tool from Google, to see how this website appears in Google Search (e.g. search terms, clicks, impressions, indexing status). Ownership of the domain is confirmed via a DNS entry (TXT record)no script and no cookie is loaded into your browser. Search Console processes no data from your visit to this website; the search queries it evaluates come from Google Search's index, which Google operates independently of this website.

Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Further information: Google Privacy Policy.

6. Data processing in the app

5.1 Sensor data (IMU, GPS, barometer)

The app captures sensor data from your smartphone (accelerometer, gyroscope, magnetometer, barometer, GPS) exclusively locally on your device. This data is never transmitted to servers.

5.2 Export files

You can export your tour data in various formats (CSV, GPX, JSON, KML, FIT, NMEA). These files remain on your device and are only shared upon your explicit action.

5.3 App settings

Settings such as layout preferences are stored locally in the app settings (UserDefaults / SharedPreferences).

7. Website hosting & delivery

This website is hosted on a server of 1blu AG (Riedemannweg 60, 13627 Berlin, Germany). Delivery is handled via the content delivery and security network of Cloudflare (Cloudflare, Inc., USA; data processing primarily in EU data centres). When the website is accessed, server log files are created for technical reasons, containing the IP address, timestamp, requested URL, and browser type. This data is used exclusively for the secure technical operation of the website and is deleted shortly afterwards.

Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in the secure operation of the website). Data processing agreements are in place with these providers; the transfer to Cloudflare is safeguarded by EU Standard Contractual Clauses.

8. Your rights (GDPR)

You have the following rights regarding your personal data:

  • Right to access (Art. 15 GDPR): What data we have stored about you
  • Right to rectification (Art. 16 GDPR): Correction of inaccurate data
  • Right to erasure (Art. 17 GDPR): Uninstalling the app completely deletes all local data
  • Right to object (Art. 21 GDPR): Objection to processing based on legitimate interests (e.g. audience measurement, see section 4.4)
  • Right to data portability (Art. 20 GDPR) and restriction of processing (Art. 18 GDPR)
  • Right to lodge a complaint: With the competent supervisory authority – Bavarian State Office for Data Protection Supervision (BayLDA), Postfach 606, 91511 Ansbach, Germany, www.lda.bayern.de
